Description: The National Park Service is developing a new Nationwide Programmatic Agreement to address compliance with Section 106 of the National Historic Preservation Act and implementing regulations (36 CFR 800). The PA addresses activities within the national parks that may affect properties of historic or cultural significance.

Pursuant to the Advisory Council on Historic Preservation's regulations (36 CFR 800), the principal signatories of this nationwide PA are the ACHP, the National Conference of State Historic Preservation Officers, and the NPS. However, we want to ensure that development of the new PA includes meaningful participation by interested parties, notably Indian Tribes, Native Hawaiians, and professional organizations with an interest in cultural resources and park management.

This draft seeks to continue those provisions and practices in the existing NPS PA (1995) that have proven effective, while charting a new course for the future management of cultural resources in the parks. To assist in your review, also provided is a spreadsheet with all comments received on the First Draft of the Programmatic Agreement, which was available for review in the Fall 2007. This spreadsheet also provides information on how various comments have been addressed in the Second Draft. In addition, a side-by-side comparison of the First and Second Draft documents is provided. Comments on the Second Draft may be provided until June 20, 2008.
